Terms of sale

01Purpose and enforceability

These terms govern commercial transactions between Artaun Hosting (hereafter “We”) and its customers (hereafter “the Customer”). Any order implies the Customer’s unreserved acceptance of these terms.

02Nature of obligations

We undertake an obligation of means. Given the technical complexity of the services, we do not guarantee the complete absence of interruption. Technical unavailability alone cannot give rise to damages.

03Pricing and payment

Prices. The applicable prices are those in force on the day of the order. We may change them at any time for future orders.

Late payment. Any delay results in suspension of services without prior formal notice. Suspension does not release the Customer from outstanding debts.

Refunds. Once a service has been activated, no refund is granted, whatever time remains.

04Limitation of liability

Cap. The total amount of compensation payable by us may not exceed the net amount paid by the Customer over the last three months.

Excluded damages. We are not liable for indirect damage: loss of revenue, loss of data or reputational harm.

05Data integrity

The Customer is solely responsible for backing up their data. Artaun Hosting cannot be held liable for loss or corruption of files. Setting up an external backup is the Customer’s responsibility.

06Termination for breach

We may terminate any contract without notice in the event of failure to meet contractual obligations. Sums already paid remain ours as a penalty clause.

07Right of withdrawal

As these are digital services whose performance begins with the Customer’s agreement, the Customer expressly waives the right of withdrawal as soon as the service is made available.

08Delivery and jurisdiction

Service activation is automated. This contract is governed by French law; in the event of a dispute, exclusive jurisdiction lies with the competent courts.
